@somem It's only in the case of a crime in progress. If it turns out to not be a real gun (for example it being an airsoft replica or a chromed bent tube) it's still justified as the cop can't reasonably know whether it is real or not in a situation of danger, and must prioritize the life of bystanders and himself above that of the criminal. Under daylight or with enough artificial light the cop is still required to order the suspect to drop the weapon before being allowed to shoot. The resolution is aimed mostly at cases where the criminal attempts to escape the scene or threaten civilans and/or cops at "gunpoint". If the criminal drops the "weapon" the cop no longer is allowed to shoot.
It doesn't apply when the one with the "gun" has done nothing, or complied with the cop's request to drop it or identify themselves.
The law must focus on whether it looks like a gun over whether it is actually a gun if it's a crime in progress, as it can't be immediately ascertained and in the case it turns out to be a real gun, the cop might not have time to act before someone is dead or badly wounded. After all, you'll know if it's real or a replica either when the criminal has been detained or when the criminal has opened fire. -
I mean now the court ping-pong will start with "it's inconstitutional" "no but this other law endorses it" "but you're mom gay" et cetera, but the important thing is the overwhelming support of the population has been shown and thus congress is pushed to act against criminals as the political landscape has clearly changed from zaffaroni's times.

Guess the local government is finally doing things that benefit the population. And perhaps now the extreme left and the criminals will realize they're the minority and they can't hold the entire country in their pocket through fear and "human rights" any longer.-
