My feeling on free speech arguments is that they should not be appeals to fairness or the marketplace of ideas: but that people are frail, stupid, arrogant and vindictive; and neither as individuals or as groups have the competence to judge expression as being out of bounds. Social change requires crossing acceptability boundaries which de facto proves that we are not competent to legally police speech.
