      1. @redenchilada I think they're paying them just because it's publicity for their games, but it's still not very sound, and doesn't make much sense to me. I don't know why it can't just be left alone as is.

          1. @redenchilada Eh. There are a good number of people who treat it as a job, providing entertaining videos for people to watch, and they get money for ads and whatnot. It may not be a job in the normal sense, but it can be a job.

                1. @mobstalyre The difference is in where they get their content. LPers are recording commercial games and using them as their primary source of content. They're similar to fanart in that sense. It's technically copyright infringement anyway so I can't see why they should get money from it.

          3. @redenchilada It's a job in the field of entertainment. In any case the legal option would be to first get in contact with the copyright holders of the games to get permission to record and broadcast the gameplay, and then monetize it. That's the real problem, monetizing the intellectual property of others without their consent.

            1. @thenerthfather @redenchilada Thing is, Nintendo even approves of let's plays, they once asked therunawayguys to play NSMB2 Nintedo is ok with let's plays they think it's a good way to commecialize games. So why the hell are they doing this is beyond me.

              1. @mobstalyre The fair use licence clearly states that the content may be used for satyrical or similar purposes, in a completely non-commercial way. Nintendo is OK with them recording gameplay and uploading them to the internet. They are not OK with third parties making a revenue out of their property.

If let's players don't get payed some will completely quit, when that happens Nintendo games won't be covered by people. When that happens what will happen to obscure games that will never survive on their own? If it weren't for let's players like Chuggaaconroy okami would still be dead. If it weren't for let's players the walkingdead game wouldn't have even been a thing. But hell what do i know i'm not a company who wants more money than it needs.

So they don't get to take the revenue from ads that play next to their video of someone else's game that's being hosted on someone else's site? If there was any regular monetary commitment at all required from them in order to specifically make the videos then I might could see an argument.

                                  1. @mobstalyre Let's Plays and the people who watch them make up such an insignificant portion of game developer's audience that it doesn't really matter if they hurt the LPer's feelings by not letting them profit from their videos of them playing other people's games.

                                2. @redenchilada @flamingpandaomg @thenerthfather It's certainly a tricky situation for the LPers who choose to monetise, because there's no precedent that Let's Plays are even considered fair use. Most people who've managed to make a job out of this generally make it by playing indie games, which makes sense because they are not going to mind the popularity or the views/sales of people finding out about their game.

                            2. Gentlemen, I find your conversation interesting, but do viewership-boosting game reviews get approved by publishers? They can certainly boost revenue through online ads and magazine sales, I see it as the same as youtube ad revenue for posting your footage.
