@mobstalyre Let's Plays and the people who watch them make up such an insignificant portion of game developer's audience that it doesn't really matter if they hurt the LPer's feelings by not letting them profit from their videos of them playing other people's games.

But even then there's not really an argument that can be made in their favor. It's the same reason why this site couldn't be monetized, or why I couldn't sell FiM t-shirts and make money off of them. Licenses are needed in order to profit from someone else's property, and "sure you guys can record videos of our games" is not a license to profit.

@mobstalyre Again I ask: what's the big deal? So they don't get to take the revenue from ads that play next to their video of someone else's game that's being hosted on someone else's site? If there was any regular monetary commitment at all required from them in order to specifically make the videos then I might could see an argument.

@mobstalyre The fair use licence clearly states that the content may be used for satyrical or similar purposes, in a completely non-commercial way. Nintendo is OK with them recording gameplay and uploading them to the internet. They are not OK with third parties making a revenue out of their property.

@redenchilada It's a job in the field of entertainment. In any case the legal option would be to first get in contact with the copyright holders of the games to get permission to record and broadcast the gameplay, and then monetize it. That's the real problem, monetizing the intellectual property of others without their consent.

@mobstalyre The difference is in where they get their content. LPers are recording commercial games and using them as their primary source of content. They're similar to fanart in that sense. It's technically copyright infringement anyway so I can't see why they should get money from it.
